Agenda Summary. Regular Scheduled meeting with special guest, Bill Hand from Bay Harbor Subdivision.

Not in Attendance, Marina Sec 8 Stan Krupa.

 

Guests: Bill Hand, Past President Bay Harbor and numerous Terramar residents.

 

Minutes of the Meeting. 

 

10:10 a.m. Meeting called to order and quorum established.

 

Guest Speaker: Bill Hand, Past President Bay Harbor subdivision spoke about the reasons Bay Harbor chose not to be a member of the West Galveston Island Property Owners Association (WGIPOA).  Bay Harbor residents were opposed to the Centex development on the far west end and WGIPOA was not adequately representing their position.

 

Motion to amend minutes: Pat Kirk made a motion which was seconded and approved to amend the September 15th board minutes to correctly reflect Betsy Redfield as a board member of Bay Harbor Improvement Association, not President.

 

Treasurer Report by Marcy Anderson.  Treasurer’s Report dated 10/10/07 submitted, along with invoice for legal services from Butler and Hailey for $700. Checking account balance of $32,015.24, CD $102,219.18 and Maintenance fees receivable $5,841.90.

 

Architectural Committee Report by Bob Majewski.  Plans were submitted for a new house in section 6 but were rejected because the owner wanted a variance to extend the home into the building setback. Plans were received for new house in Section 7 without a certified engineer’s seal so waiting on proper set to review. Gave approval for a fence in Section 4 as long as it wasn’t wood and not over 4 feet.  Kathy Ringrose asked that section leaders be notified of Architectural Committee Reviews, in their respective sections and Bob said he would call the section leaders anytime that plans were to be reviewed in the future.

 

Dredging Committee Report by Pat Kirk. Galveston County has promised $25,000. Grant through Coastal Beach & Bay Foundation. This is in addition to the grant already received from Fish & Wildlife. Gahagen and Bryant were hired and have finished the first two tasks in the contract.  Bathometric survey and core samplings completed. Committee met to discuss results and proposed new dredging will be at the same locations as the existing channel but up to 2600 long instead of 1600. Estimated cost of dredging alone is $99,000.  We are now entering second phase of contract which will take us through preliminary design and permitting of the proposed project at County Pocket Park #4.  CMP Cycle 13 Grant was submitted. Fish America grant is currently being worked on in conjunction with Bay Harbor. Other sources of funding are being considered. Terramar did not receive funding from CEPRA or CIAP. Engineering began in October of 2007 and estimated completion of project is October of 2008.

 

Maintenance Report by Bob Majewski. Lights at Marina were donated by Raul Molina and have been installed. Pool is still leaking and may have to contact Leak Detector to find. Kim Saxon commented that electrical repairs should be contracted through a licensed electrician.

 

Landscaping Committee Report by Kim Saxon. Contacted appropriate party for replacement of four dead Palm Trees under warranty. Palms will be replaced but  currently there is a moratorium on the export of Florida Palms so they are hard to come by.

 

Section 1 Report by Ed Hartman.  Beach clean ups have been very successful and the beach area is looking very good. Next clean up will be in April.

 

Section 2 Report by Jeff Baker. Reported several break-ins over the Bike Rally weekend. No suspects caught.

 

Section 3 Report by Pat Kirk. Reported two break-ins the same weekend. No suspects caught, but discussion that it does not appear to be related to the Bike Rally guests but a group that are working their way down the Island. Other subdivisions reported similar activities.

 

Section 4 Report by Kim Saxon. Reported her golf cart stolen but found during same time frame. Also several other incidents of report of stolen cell phones and car break ins.

 

Section 5 Report by Bonny English. Next Adopt A Beach day is APRIL 2008 and then again in SEPTEMBER. Certified letter sent to resident with broken appliance under their house and it was immediately removed and looks much better.

 

Section 6 Report by Kathy Ringrose. Received one complaint about high grass.

 

Section 7 Rick Gonzalez. Rick Gonzalez introduced as new section leader for section 7 from judge ruling that proxy votes are not allowed although final outcome of summary judgment has been asked to be reviewed for clarification. Both sides told they won. Rick Gonzalez, a practicing attorney for 23 years, states the signed summary judgment prevails. Wanda Greer expresses concern of insurance rates for the subdivision increasing or insurance being dropped all together with continued lawsuit. Ed Nadalin said we cannot stop people from suing the subdivision.

 

Marina Section Leader Stan Krupa not in attendance. Ed Nadalin announced Krupa had asked us to discuss establishing a boating club.

 

Unfinished Business.  Pat Kirk makes a motion to vote on renewing membership in West Galveston Island Property Owners Association (WGIPOA). Motion seconded and approved unanimously.

 

New Business. Bob Majewski brings up for discussion extending swimming pool hours.  Marcy Anderson, Treasurer, to research cost and board to reconsider after costs reviewed at a later meeting. Resident, Linda Reed, addresses group to announce the establishment of a social group for the neighborhood to be called the TERRAMARTIAN‘S.  Four Galveston Police officers spoke on the recent break-ins and recommended locking car doors. They did not think visitors from the Bike Rally were responsible for the break ins, but a group that have been working their way down the Island since other subdivisions had similar type break-ins previously. Attending residents expressed concern for speeding in the neighborhood and how to stop it.  Installation of speed bumps discussed.

 

Open discussion.  Lloyd Pepper addressed the group on his concern of current officers voting as an Executive Committee when the by-laws give each board member equal voting rights. General discussion concluding all board members will be included in voting on all future board issues. Kim Saxon expressed the importance of following our by-laws and Roberts Rule of Order. Newsletter needs approval of entire board before posting to TBCIA website along with getting approval for establishment of committees for the subdivision, no matter how good the intentions of the committees.

 

Outcome of litigation discussed. Both sides told they won so Pat Kirk and Bonny English asking for clarification and cannot discuss litigation in progress. Rick Gonzalez states the summary judgment signed by the judge prevails. Residents to be notified when decided. Wanda Greer states concern for continued litigation affecting insurance rates.

 

A motion to adjourn was denied so Terramar resident Teri Keeler could make a statement to the board in which she said that in retaliation to an email sent out to Terramar Residents expressing her view on the work of the board, Wendy Majewski had contacted her employer at UTMB to complain that the email was sent from a company email account on company time. Terry said she felt this was an obvious attempt to get her in trouble for expressing her opinion and hopes other residents will not be subjected to future retaliation for expressing their views. Bob Majewski responded why this happened; stating last year his wife had expressed her opinion and retaliation by the board included seeking legal counsel which cost the subdivision $700. and the cancellation of three of her AOL accounts.
